Who You Are

Under the Nobby Design Terms of Service, you must be at least 18 years old and not a person barred from receiving services under the laws of the United States or other applicable jurisdictions to use our website. Persons between the age of 13 and 18 should use our website only with the consent and supervision of your parents or guardian.

To provide you with the full Nobby Design shopping experience, we collect and retrieve your personal information in a number of different ways. Why we collect your information and what we do with it depends on the type of information.

We collect information when you register online or update your account, log-in, place an order, communicate online with our customer service representatives, opt-in to receive our emails,  participate in a sweepstake,  promotion or survey, or join our social networking sites. This information may include, but is not limited to, your contact information (for example, your name, email address, billing and shipping addresses and phone number)

The information we collect or have collected within the past twelve months is detailed below:

Name

Purpose:

For shipment or billing details.To personalize your contact or website experiences.We also use this to keep you in the Nobby Design loop so that, from time to time, we can send you catalogs, special offers and promotions.

Disclosure: We may disclose this information to agents (credit card clearing agencies,). In all instances, we provide them with only the information they need to perform their function.

We use your name to respond to your queries and occasional complaints. We may also keep a record of these to inform any future communications with us, to show how we communicated with you throughout, and to ensure that we provide you with the best possible service.

 

Email address

Purpose: We use this so that we can email your order confirmations, let you know about delivery delays, send you offers and keep you up-to-date on our shiny new products. Click here to unsubscribe from email marketing at any time.

We may need to use your email address to send you communications that are required by law or necessary to inform you about any changes to the services we provide you.

If you register as our member, we will use your email address to keep in touch with you and send regular notifications of member activities

We use your email address to respond to your queries and occasional complaints. We may also keep a record of these to inform any future communications with us, to show how we communicated with you throughout, and to ensure that we provide you with the best possible service.

If you work with us as an influencer, we may collect your email address. We use your email address to engage with you and to administer events.

We don’t sell your email address to anyone.

Shipping address

Purpose: An obvious one – so we can ship your goods to you. In addition, we use this to process orders to you, and for fraud prevention and detection.

If you work with us as an influencer, we may collect your address. We may use your address to send presents to you.

We don't pass on addresses to anyone for commercial purposes

Telephone number / Cell number

Purpose: We’ll only call if we have a delivery problem, and we might text you with details about your orders or if we have a question.

 

Sale: We do not sell this information to third parties.

Credit card details

 

Purpose: We only ask for these when you place an order. You may choose to save your card details to speed up the checkout process. If you wish to remove your card details at a later date, you can do so by deleting your saved card from account preferences on the website. We will securely store your payment card information for one year, to allow us to process refunds in accordance with our Refund Policy.

 

Sale: We do not sell this data to third parties.

Your Internet Protocol (IP) address

 

Purpose: We collect your IP address to learn more about how you use our website. IP address data allows us to analyse site usage and visitor numbers and see how our advertising performs (so we can understand what you like). We also use this information to improve our website, which makes our marketing more relevant to give you the best experience we can.

Photographs

 

Purpose: If you upload your photographs to Nobby Design Review (please keep them coming), these may be published on our website along with your name or social media username.

 

If you work with us as an influencer, we may collect images of you, and clothing size. We may post your images on our own social media pages and Nobby Design websites (contractual performance).

Social Media Username

 

Purpose: If you interact with us on social media, we use your social media username or identifier to help us respond to your comments, questions or feedback.

Purpose:

To prevent and detect fraud against either you or Nobby Design

PROTECTING YOUR INFORMATION

We use the latest secure server technology to ensure this information is protected to the highest standards. Any personal information you provide to us is safely stored on secure servers.

  1. We protect your data using encryption using the Secure Sockets Layer (SSL). SSL is a function that encrypts all information sent between buyer and seller,including card information, so that card details cannot be read by externalparties.

COOKIES AND WEB BEACONS

 

Cookies are small text files that websites send to your computer. A cookie can be thought of as an Internet user's identification card. They let the website know when the user has returned. This lets the site bring up information relevant to that user, for example your name, past orders, etc.

The Nobby Design website uses cookies to allow customers to move from one part of the web site to another and to add items to the shopping basket without having to log in repeatedly.

Browsing behavior is also used to create relevant banner advertising with product recommendations that we believe best relate to the items you viewed on our website. This process is called behavioral advertising and although the adverts are individually tailored to each visitor, all cookie data is anonymized and stored temporarily.  We use the browsing behavior data to create personal product recommendations on our website, our marketing emails and in our printed catalog.

Your rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and verify your request, we will disclose to you:

  • The categories of sources from which the personal information is collected.
  • The specific pieces of personal information we collected about you.
  • Our business or commercial purpose for collecting or selling any personal information.
  • The purposes for which the information we collected will be used.

  • If we sold or disclosed your personal information for a business purpose; and, if so, any categories of personal information that were sold or disclosed, and the categories of any third parties to whom personal information was sold or disclosed.

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and verify your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our agreement with you.

Verifiable Requests

Only you or a person that you authorize to act on your behalf may make a verifiable consumer request related to your personal information. However, you may also make a verifiable consumer request on behalf of your minor (under 16) child.

In order to respond to your requests, we must perform some verification. For example, this would be necessary in order for us to respond to any requests for to disclose or delete your data. Our verification methods will differ depending on the following circumstances:

Password-protected accounts – if you have a password-protected account with us, we will use password authentication to verify you. If your request is for deletion of personal information, we will need to re-verify you before we delete your information.

Non-password-protected accounts – we need to use either a two-tier or a three-tier verification process (which will depend on what type of request you are making). We will ask for you to confirm two or three pieces of information that we have on our records about you, for example:

  • Your address
  • Your zip code
  • Your most recent purchase
  • Your email address

We will never ask for the following information from you:

  • Social security number
  • Medical and health information
  • Financial account number
  • Account passwords
  • Security questions and answers

Frequency

You may make a verifiable consumer request up to two times within a twelve-month period, without charge. Unfortunately, we cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timelines

We try to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time, we will inform you of the reason and extension time period (up to 90 days). If you have an account with us, we will deliver our response to that account. If you do not have an account with us, we will deliver our response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve-month period preceding receipt. The response we provide will also explain any reasons we cannot comply with a request, if applicable. 

Opting-Out of Sale of Personal Information

If you wish to opt-out of the sale of personal information, please use one of the methods in the 'Contact Us' section. If exercised, the decision to opt-out will be valid for 12 months, at which time we may request that you authorize the sale of personal information again.

Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
